1. EXPLOREPASS.CA ACCESS
1.1 Access to our site is permitted on a temporary basis and we reserve the right to withdraw or amend access without notice. We will not be liable if for any reason our site is unavailable at any time or for any period.
1.2 From time to time we may restrict access to some parts of our site or to the entire site to customers only.
1.3 You are responsible for making all arrangements necessary for you to have access to our site. You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these Terms and that they comply with them.
1.4 We aim to update our site regularly and may change the content at any time. If the need arises we may suspend access to our site or close it indefinitely. Any of the material on our site may be out of date at any given time and we are under no obligation to update such material. We may also revise these Terms at any time. Some of the provisions contained in these Terms may also be superseded by provisions or notices published elsewhere on our site.
1.5 You may only use our site for lawful purposes. You may not use it in any way that breaches any applicable local, national or international law or regulation, or for any unlawful or fraudulent purpose.
2. INTELLECTUAL PROPERTY RIGHTS
2.1 We are the owner or licensee of all intellectual property rights in our site and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved and no part of the site may be copied, adapted or published without ExplorePass.ca’s prior written permission.
2.2 Our status (and that of any identified contributors) as the author of material on our site must always be acknowledged.
3.1 Commentary and other materials posted on our site are not intended to amount to advice on which reliance should be placed. We therefore disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to our site or by anyone who may be informed of any of its content.
3.2 The material displayed on our site is provided without any guarantees, conditions or warranties as to its accuracy. If you believe that the content of any information is unlawful or unacceptable please notify ExplorePass.ca with details.
3.3 Nothing in the clause affects our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation, nor any other liability which cannot be excluded or limited by law.
4. WEBSITE VIRUSES
4.1 You may not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs and/or other material which is malicious or technologically harmful. You must not attempt to gain unauthorized access to our site, the server on which it is stored or any server, computer or database connected to our site. You must not attack our site via a denial or distributed denial of service attack. We will report any breach of this provision to the relevant law enforcement authorities and we will cooperate with them by disclosing your identity to them.
4.2 We will not be liable for any loss or damage caused by a denial of service attack, virus or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site, or to the downloading of any material posted on it or on any website linked to it.
5. LINKING TO OR FROM OUR SITE
5.1 You may link to our home page provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists. You must not establish a link from any website that is not owned by you.
TERMS OF PURCHASE & CONDITIONS OF EXPLORE PASS USAGE
1.1 “The Pass” is the physical ticket purchased at any d3h Hotel location.
2. CANCELLATION & REFUNDS
2.1 Cancellations and refunds for the pass cannot be refunded. Negative experiences at partner locations are to be handled with the Explore Pass Partner. If concern comes up we will try our best to work with guest for a solution but we are not liable.
3. CONDITIONS OF USE
3.1 The Pass entitles the holder to admission to listed attractions and services (“Attractions”) upon presentation with or without further payment, depending on the offer stated at explorepass.ca.
3.2 There is no limit to one pass per person, passes can be combined for larger deals based on the partner's offer.
3.3 Pass(es) may not be resold, except by contracted wholesalers of Explore Pass or d3h Hotels products.
3.4 Use of a single pass to gain admissions for multiple explorepass partners constitutes fraud and may be subject to legal action. Explore Pass customers agree to reimburse Explore Pass costs incurred through misuse of the pass including amounts Explore Pass is contractually bound to pay visited Attractions, as well as legal and recovery costs incurred by Explore Pass to obtain such reimbursement from customers. Should the passholder use the pass improperly, the passholder agrees to indemnify Explore Pass for any damages suffered as a result of such misuse.
4. EXCLUSIONS AND DISCLAIMERS
4.1 Explore Pass has done its best to ensure the accuracy of the information on our website and in the Attraction descriptions, which will accompany Passes. Because conditions, including but not limited to hours, holiday closures, etc. at these Attractions may change from time to time subsequent to the purchase date, Explore Pass cannot guarantee that each facility will continue to honor its indicated commitments at the time that the Passholder makes use of the Pass. To the extent permitted by law, Explore Pass is not liable for any loss, expense, damage, or other inconvenience caused in any way by the passholder's reliance upon information contained on the website or in the Attraction descriptions accompanying your Pass.
5.2 Occasionally, an error may occur, and products may be either incorrectly priced or described in which case we are not obliged to supply the goods at the incorrect price or in accordance with the incorrect description or at all. We reserve the right to correct any errors from time to time. We will (at our discretion) either cancel your order and refund the price you have paid or use reasonable endeavors to contact you and ask you whether you wish to continue with the order at the correct price or correct description. If we are unable to contact you or you do not wish to continue with the order at the correct price or correct description, we will cancel your order and refund the price you have paid.
5.1 Explore Pass shall not be liable for any deficiencies in service, problems with admission, public health violations, safety problems, or personal injury or sickness, including any health and safety matters with COVID-19, that should arise when the Passholder visits any listed Attraction. Such problems shall be a matter to be resolved between the Passholder and that facility, just as it would be the case if a customer conducted business with any facility without the use of Explore Pass products.
5.2 Explore Pass is not responsible for traffic conditions or weather that may affect a customer’s ability to use Explroe Pass products.
5.3 Explore Pass is responsible to you for foreseeable loss and damage that may be caused by us (not by any third party), where we are in breach of these Terms or we fail to use reasonable skill and care.
5.4 We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or that of our employees or agents, or for fraud or fraudulent misrepresentation.
5.5 Explore Pass will not be liable in any amount for failure to perform any obligation under these Terms if such failure is caused by the occurrence of any unforeseen contingency beyond our reasonable control, including without limitation internet or communications outages, fire, flood, terrorism, war, pandemic, act of God, or Force Majeure.
6.6 Nothing in these Terms shall exclude or limit any statutory or common law rights that you enjoy as a consumer.
6.1 If Explore Pass does not enforece any provision of these Terms this will not be considered a waiver of any provision or right. If we delay in enforcing these Terms we can still enforce them at a later time.
